516N/Adescribed therein may be protected by one or more
U.S. patents, foreign
516N/Apatents, or pending applications. Except as provided under the
516N/Afollowing license, no part of the Specification may be reproduced in
516N/Aany form by any means without the prior written authorization of Oracle
516N/AAmerica, Inc. ("Oracle") and its licensors, if any. Any use of the
516N/ASpecification and the information described therein will be governed by
516N/Athe terms and conditions of this Agreement.
516N/ASubject to the terms and conditions of this license, including your
516N/Acompliance with Paragraphs 1 and 2 below, Oracle hereby grants you a
516N/Afully-paid, non-exclusive, non-transferable, limited license (without
516N/Athe right to sublicense) under Oracle's intellectual property rights
516N/Aincludes: (i) developing implementations of the Specification for your
516N/Ainternal, non-commercial use; (ii) discussing the Specification with
516N/Aany third party; and (iii) excerpting brief portions of the
516N/ASpecification in oral or written communications which discuss the
516N/ASpecification provided that such excerpts do not in the aggregate
516N/Aconstitute a significant portion of the Technology.
516N/Atheir testing and evaluation use, provided that any such
516N/A(i) does not modify, subset, superset or otherwise extend the Licensor
516N/AName Space, or include any public or protected packages, classes, Java
516N/Ainterfaces, fields or methods within the Licensor Name Space other than
516N/A(ii) is clearly and prominently marked with the word "UNTESTED" or
516N/A"EARLY ACCESS" or "INCOMPATIBLE" or "UNSTABLE" or "BETA" in any list of
516N/Aavailable builds and in proximity to every link initiating its
516N/Adownload, where the list or link is under Licensee's control; and
516N/A(iii) includes the following notice:
516N/A"This is an implementation of an early-draft specification developed
516N/Aunder the Java Community Process (JCP) and is made available for
516N/Atesting and evaluation purposes only. The code is not compatible with
516N/Aany specification of the JCP."
516N/AThe grant set forth above concerning your distribution of
516N/Aimplementations of the specification is contingent upon your agreement
516N/Ato terminate development and distribution of your "early draft"
516N/Aimplementation as soon as feasible following final completion of the
516N/Aspecification. If you fail to do so, the foregoing grant shall be
516N/Aconsidered null and void.
516N/ANo provision of this Agreement shall be understood to restrict your
516N/Aability to make and distribute to third parties applications written to
516N/AOther than this limited license, you acquire no right, title or
516N/Ainterest in or to the Specification or any other Oracle intellectual
516N/Aproperty, and the Specification may only be used in accordance with the
516N/Alicense terms set forth herein. This license will expire on the earlier
516N/Aof: (a) two (2) years from the date of Release listed above; (b) the
516N/Adate on which the final version of the Specification is publicly
516N/Areleased; or (c) the date on which the Java Specification Request (JSR)
516N/Ato which the Specification corresponds is withdrawn. In addition, this
516N/Alicense will terminate immediately without notice from Oracle if you
516N/Afail to comply with any provision of this license. Upon termination,
516N/Ayou must cease use of or destroy the Specification.
516N/A"Licensor Name Space" means the public class or interface declarations
516N/Aequivalents in any subsequent naming convention adopted by Oracle
516N/Athrough the Java Community Process, or any recognized successors or
516N/ANo right, title, or interest in or to any trademarks, service marks, or
516N/Atrade names of Oracle or Oracle's licensors is granted hereunder.
516N/AOracle, the Oracle logo, Java are trademarks or registered trademarks
516N/Aof Oracle USA, Inc. in the
U.S. and other countries.
516N/ADISCLAIMER OF WARRANTIES
516N/ATHE SPECIFICATION IS PROVIDED "AS IS" AND IS EXPERIMENTAL AND MAY
516N/ACONTAIN DEFECTS OR DEFICIENCIES WHICH CANNOT OR WILL NOT BE CORRECTED
516N/ABY ORACLE. ORACLE MAKES NO REPRESENTATIONS OR WARRANTIES, EITHER
516N/AEXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF

C.F.R. 227.7201 through 227.7202-4 (for
516N/ADepartment of Defense (DoD) acquisitions) and with 48
C.F.R. 2.101 and
516N/A12.212 (for non-DoD acquisitions).
516N/AYou may wish to report any ambiguities, inconsistencies or inaccuracies
516N/Ayou may find in connection with your evaluation of the Specification
516N/A("Feedback"). To the extent that you provide Oracle with any Feedback,
516N/Ayou hereby: (i) agree that such Feedback is provided on a
516N/Anon-proprietary and non-confidential basis, and (ii) grant Oracle a
516N/Aperpetual, non-exclusive, worldwide, fully paid-up, irrevocable
516N/Alicense, with the right to sublicense through multiple levels of
516N/Asublicensees, to incorporate, disclose, and use without limitation the
516N/AFeedback for any purpose related to the Specification and future
516N/Aversions, implementations, and test suites thereof.
516N/AAny action related to this Agreement will be governed by California law
516N/AInternational Sale of Goods and the choice of law rules of any
516N/Ajurisdiction will not apply.
516N/AThe Specification is subject to
U.S. export control laws and may be
516N/Asubject to export or import regulations in other countries. Licensee
516N/Aagrees to comply strictly with all such laws and regulations and
516N/Aacknowledges that it has the responsibility to obtain such licenses to
516N/Aexport, re-export or import as may be required after delivery to
516N/AThis Agreement is the parties' entire agreement relating to its subject
516N/Amatter. It supersedes all prior or contemporaneous oral or written
516N/Acommunications, proposals, conditions, representations and warranties
516N/Aand prevails over any conflicting or additional terms of any quote,
516N/Aorder, acknowledgment, or other communication between the parties
516N/Arelating to its subject matter during the term of this Agreement. No
516N/Amodification to this Agreement will be binding, unless in writing and
516N/Asigned by an authorized representative of each party.
