5084e753b79a753c8b532c06eb3ad1d025e8e472Mark J. Nelsonreverse assemble all or any part of the Emulex Firmware, (2) disseminate
5084e753b79a753c8b532c06eb3ad1d025e8e472Mark J. Nelsonperformance information or analysis to any third party, other than solely for
5084e753b79a753c8b532c06eb3ad1d025e8e472Mark J. Nelsonproduct support purposes, from any source relating to the Emulex Firmware, or
5084e753b79a753c8b532c06eb3ad1d025e8e472Mark J. Nelsoncause or permit others to do either of both of the foregoing. Licensee

5084e753b79a753c8b532c06eb3ad1d025e8e472Mark J. NelsonBoth parties shall adhere to all applicable laws, regulations, and rules
5084e753b79a753c8b532c06eb3ad1d025e8e472Mark J. Nelsonrelating to the export of Emulex Firmware and any other information provided
5084e753b79a753c8b532c06eb3ad1d025e8e472Mark J. Nelsonhereunder. If any term or condition of this Agreement is held invalid,
5084e753b79a753c8b532c06eb3ad1d025e8e472Mark J. Nelsonillegal or unenforceable by a court of competent jurisdiction, all the other
5084e753b79a753c8b532c06eb3ad1d025e8e472Mark J. Nelsonterms and conditions shall survive. The Emulex Firmware may be provided to
5084e753b79a753c8b532c06eb3ad1d025e8e472Mark J. Nelsonunits or agencies of the U.S. government only as "commercial computer
5084e753b79a753c8b532c06eb3ad1d025e8e472Mark J. Nelsonfirmware," "restricted computer firmware," or with "restricted rights" as
5084e753b79a753c8b532c06eb3ad1d025e8e472Mark J. Nelsondefined in applicable regulations, and may not be provided as source code.
