ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza"Software" means all software provided to You in binary code form by Sun
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaunder this License as indicated on the opensolaris.org website. Software
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaincludes any updates or error corrections or documentation relating to
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaSoftware provided to You by Sun under this License as indicated on the
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza2. Permitted Uses.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaSubject to the terms and conditions of this Agreement and restrictions and
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaexceptions set forth in the Software's documentation, Sun grants you a
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazanon-exclusive, non-transferable, limited license without fees to
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza(a) reproduce and use internally the Software for the purposes of
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazadeveloping or running an Open Solaris distribution.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza(b) reproduce and distribute the Software (and also portions of Software
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaidentified as Redistributable in the documentation accompanying Software),
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaprovided that you (i) distribute the Software or Redistributables bundled
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaas part of, and for the sole purpose of running, OpenSolaris code;
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza(ii) do not remove or alter any proprietary legends or notices contained
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazain or on the Software or Redistributables, (iii) only distribute the
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaSoftware or Redistributables subject to a license agreement that protects
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaSun's interests consistent with the terms contained in this Agreement,
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaand (iv) you agree to defend and indemnify Sun and its licensors from and
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaagainst any damages, costs, liabilities, settlement amounts and/or
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaexpenses (including attorneys' fees) incurred in connection with any claim,
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazalawsuit or action by any third party that arises or results from the use
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaor distribution of any and all Programs, Software, or Redistributables.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza3. Restrictions.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza(a) The copies of Software provided to you under this Agreement is
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazalicensed, not sold, to you by Sun. Sun reserves all rights not expressly
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza(b) You may not modify Software. However if the documentation
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaaccompanying Software lists specific portions of Software, such as header
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazafiles, class libraries, reference source code, and/or redistributable
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazafiles, that may be handled differently, you may do so only as provided in
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazathe documentation.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza(c) You may not rent, lease, lend or encumber Software.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza(d) You do not remove or alter any proprietary legends or notices
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazacontained in the Software,
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza(e) Unless enforcement is prohibited by applicable law, you may not
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazadecompile, or reverse engineer Software.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza(f) The terms and conditions of this Agreement will apply to any Software
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaupdates, provided to you at Sun's discretion, that replace and/or
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazasupplement the original Software, unless such update contains a separate
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza(g) Software is copyrighted.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza(h) Software is not designed, licensed or intended for use in the design,
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaconstruction, operation or maintenance of any nuclear facility and Sun
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaand its licensors disclaim any express or implied warranty of fitness for
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza(i) No right, title or interest in or to any trademark, service mark,
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazalogo or trade name of Sun or its licensors is granted under this
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza(j) If your Permitted Use in this Agreement permits the distribution
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaSoftware or portions of the Software, you may only distribute the Software
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazasubject to a license agreement that protects Sun's interests consistent

ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza4. Java Compatibility and Open Source.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaSoftware may contain Java technology. You may not create additional
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaclasses to, or modifications of, the Java technology, except under
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazacompatibility requirements available under a separate agreement available
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaSun supports and benefits from the global community of open source
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazadevelopers, and thanks the community for its important contributions and
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaopen standards-based technology, which Sun has adopted into many of its
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaPlease note that portions of Software may be provided with notices and
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaopen source licenses from such communities and third parties that govern
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazathe use of those portions, and any licenses granted hereunder do not
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaalter any rights and obligations you may have under such open source
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazalicenses, however, the disclaimer of warranty and limitation of
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaliability provisions in this Agreement will apply to all Software in
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazathis distribution.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza5. Term and Termination.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaThe Agreement is effective on the Date you recieve the Software and
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaremains effective until terminated. Your rights under this Agreement
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazawill terminate immediately without notice from Sun if you materially
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazabreach it or take any action in derogation of Sun's and/or its
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazalicensors' rights to Software. Sun may terminate this Agreement should
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaany Software become, or in Sun's reasonable opinion likely to become,
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazathe subject of a claim of intellectual property infringement or trade
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazasecret misappropriation. Upon termination, you will cease use of, and
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazadestroy, Software and confirm compliance in writing to Sun. Sections 1,
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza3, 4, 5, and 7-13 will survive termination of the Agreement.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza6. Limited Warranty.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaSun warrants to you that for a period of 90 days from the date of
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazareceipt, the media on which Software is furnished (if any) will be free
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaof defects in materials and workmanship under normal use. Except for
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazathe foregoing, Software is provided "AS IS". Your exclusive remedy and
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaSun's entire liability under this limited warranty will be at Sun's
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaoption to replace Software media or refund the fee paid for Software.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaSome states do not allow limitations on certain implied warranties, so
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazathe above may not apply to you. This limited warranty gives you
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaspecific legal rights. You may have others, which vary from state to
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza7. Disclaimer of Warranty.

ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaREPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaMERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT

ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaINDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER CAUSED
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaREGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT OF OR RELATED TO THE
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaUSE OF OR INABILITY TO USE SOFTWARE, EVEN IF SUN HAS BEEN ADVISED OF THE
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaPOSSIBILITY OF SUCH DAMAGES. In no event will Sun's liability to you,
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazawhether in contract, tort (including negligence), or otherwise, exceed
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazathe amount paid by you for Software under this Agreement. The foregoing
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazalimitations will apply even if the above stated warranty fails of its
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaessential purpose. Some states do not allow the exclusion of incidental
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaor consequential damages, so some of the terms above may not be
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaapplicable to you.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza9. Export Regulations.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaAll Software, documents, technical data, and any other materials
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazadelivered under this Agreement are subject to U.S. export control laws
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaand may be subject to export or import regulations in other countries.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaYou agree to comply strictly with these laws and regulations and
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaacknowledge that you have the responsibility to obtain any licenses to
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaexport, re-export, or import as may be required after delivery to you.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza10. U.S. Government Restricted Rights.

ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaby a U.S. Government prime contractor or subcontractor (at any tier),
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazathen the Government's rights in Software and accompanying documentation
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazawill be only as set forth in this Agreement; this is in accordance with
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza48 CFR 227.7201 through 227.7202-4 (for Department of Defense (DOD)
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaacquisitions) and with 48 CFR 2.101 and 12.212 (for non-DOD acquisitions).

ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaAny action related to this Agreement will be governed by California law

ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaomission would frustrate the intent of the parties, in which case this
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaAgreement will immediately terminate.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Praza13. Integration.
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane PrazaThis Agreement is the entire agreement between you and Sun relating to
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaits subject matter. It supersedes all prior or contemporaneous oral or
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazawritten communications, proposals, representations and warranties and
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaprevails over any conflicting or additional terms of any quote, order,
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaacknowledgment, or other communication between the parties relating to
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaits subject matter during the term of this Agreement. No modification
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaof this Agreement will be binding, unless in writing and signed by an
ead1f93ee620d7580f7e53350fe5a884fc4f158aLiane Prazaauthorized representative of each party.
